Help Keep Texas Beaches Open To The Public
Proposition 9, on the Nov. 3 statewide ballot, has the potential to put the Open Beaches Act in the Texas Constitution. That act states that the public has access to all beaches between the mean low-tide line and the vegetation line, making what is now known as a rolling easement. The act has caused tension between the government and homeowners when storms or long-term erosion move the vegetation line landward, putting some private homes in the public domain. The Prop. 9 amendment aims to protect the right of the public, individually and collectively, to access and use the public beaches bordering the seaward shore of the Gulf of Mexico.
